PLANY PROMO Terms of Service
1. General provisions
- These Terms set out the rules for using the PLANY PROMO website available at planypromo.pl (the “Service”), including the conclusion and performance of contracts for services provided electronically.
- The Service is provided by Navia Natalia Cierniak, address: ul. Henryka Sienkiewicza 4/12, 27-200 Starachowice, Polish tax ID (NIP): 6642155954, REGON: 529528674, e-mail: kontakt@planypromo.pl (the “Provider”, “we”).
- Definitions:
- User – a natural person, legal person or organisation using the Service;
- Consumer – a User who is a natural person concluding a contract not directly related to their business or profession;
- Account – the User’s personal dashboard in the Service;
- Plan – a paid package of services (BASIC, PRO, MAX) described on the Pricing page (planypromo.pl/cennik);
- Subscription – a contract for access to a Plan for a monthly or yearly period, renewed automatically;
- Promo plan – a promotional campaign calendar for a release, with content ideas, captions and related materials.
- To use the Service you need an internet-connected device, an up-to-date browser with JavaScript and cookies enabled, and an active e-mail address.
- You must not upload unlawful content, content infringing the rights or personal interests of others, or take any action that disrupts the Service.
2. Account
- Creating an Account is free. Registration requires an e-mail address and password or signing in with Google, and accepting these Terms. Creating an Account concludes an open-ended contract for maintaining the Account.
- The Service is intended for persons aged 16 and over. A minor may purchase a Subscription only with the consent of their legal guardian.
- You agree to provide true and up-to-date information and not to share your login details.
- You may delete your Account at any time by e-mailing us from your Account e-mail address. Deleting the Account does not cancel payment obligations for services already provided.
- We may terminate the Account contract with 14 days’ notice for important reasons, in particular a serious breach of these Terms, and will inform you by e-mail, giving the reason.
3. Services
- A free Account gives access to a preview of the Service, including a sample promo plan.
- The free profile audit checks your public music and social media profiles and sends a PDF report to the e-mail address provided. It is available once per e-mail address and set of profiles.
- Plans include the services described on the Pricing page, in particular:
- a promo plan prepared with the help of artificial intelligence tools and reviewed by our team, delivered to your Account within 2 business days of receiving complete information about the release; the number of promo plans per billing period depends on the Plan;
- analytics – statistics from music and social media platforms with an analysis;
- other features available in the given Plan (e.g. TikTok trends, best practices, community, DUET plan).
- Analytics data is collected from publicly available profiles and from interfaces provided by platforms (e.g. Spotify, YouTube, Meta, TikTok). Its scope and availability depend on those platforms; we are not responsible for their outages, policy changes or errors in their data.
- Some content (e.g. promo plans, captions, biographies, analyses) is created with artificial intelligence tools. It is a suggestion – please review it before publishing; you decide how to use it.
- We do not guarantee specific results (such as streams, followers or views), as they depend on many factors beyond our control.
4. Subscriptions and payments
- Prices on the Pricing page are final prices in PLN, EUR or USD. You choose a monthly or yearly billing period.
- Payments in PLN are processed by Stripe Payments Europe Ltd. (Ireland), using e.g. payment cards, BLIK and Przelewy24.
- Our order process for payments in EUR and USD is conducted by our online reseller Paddle.com Market Limited. Paddle.com is the Merchant of Record for all these orders. Paddle provides all customer service inquiries related to payments and handles returns. Paddle’s Buyer Terms (paddle.com/legal/checkout-buyer-terms) also apply to these payments.
- A Subscription renews automatically for the same period and is charged at the start of each period unless you cancel it.
- You can cancel your Subscription at any time in your Account (Settings → Subscription). Cancellation takes effect at the end of the paid period; until then the Plan stays active.
- An upgrade takes effect, at the User’s choice, immediately – the User then pays the full price difference between the Plans for the current billing period and the renewal date stays the same – or from the next billing period. A downgrade and a change of billing period (monthly / yearly) take effect from the next billing period; until then the current Plan stays active.
- If a renewal payment fails, we will let you know; access to Plan features may be limited until the payment is settled.
- We will notify you of any price change by e-mail at least 30 days in advance. The change does not affect a period already paid for, and you may cancel before it applies.
5. Shop
The Shop with additional services (e.g. consultations) is available only to Users paying in PLN. Users paying in EUR or USD can contact us about additional services via the contact form; such services are agreed and billed individually, outside the Service.
6. Right of withdrawal
- A Consumer may withdraw from a distance contract within 14 days of its conclusion without giving a reason, by sending a statement to our e-mail address.
- When purchasing a Plan, the Consumer expressly requests that the service start before the withdrawal period ends and acknowledges that:
- once a promo plan (digital content not supplied on a tangible medium) is made available in the Account, the right of withdrawal is lost for that promo plan;
- if they withdraw from the rest of the contract, they pay for the services provided up to the moment of withdrawal, in proportion to the period of using the Plan.
- The Consumer gives this consent and acknowledgement at checkout, and it is confirmed in the order confirmation e-mail.
- Refunds are described in the Refund Policy.
7. Materials and intellectual property
- You confirm that you hold the rights to the materials you upload (tracks, photos, videos, texts) and that people visible in them have agreed to the use of their image.
- You grant us a non-exclusive, free licence to store, copy, crop and analyse uploaded materials (including with artificial intelligence tools) solely to provide the services, for as long as you use the Service. We do not publish your materials without your separate consent.
- You may freely use promo plans and other content prepared for you to promote your work. All rights to the Service, its design, software and templates belong to the Provider.
- You may connect your accounts on third-party services (e.g. YouTube, Instagram, Facebook, TikTok) through their official sign-in window (OAuth) or provide your own access keys. You do so voluntarily and in line with those services’ terms; by connecting a YouTube channel you agree to the YouTube Terms of Service (youtube.com/t/terms). We use this access only to collect your statistics and, if you enable publishing, to publish content you have approved. You can remove a connection at any time in Settings → Connected accounts or in the settings of the given service. Details are in the Privacy Policy.
8. Complaints
- Complaints about the Service can be sent to our e-mail address, describing the issue and giving your Account e-mail.
- We respond to complaints by e-mail within 14 days of receipt.
- Complaints about payments in EUR and USD are handled by Paddle (paddle.net); we will help to resolve them.
9. Liability
- We strive to keep the Service available without interruption, but short technical breaks may occur; we announce longer ones in advance.
- Towards Users who are not Consumers, our liability is limited to the fees paid by the User in the last 12 months, except for damage caused intentionally. This limitation does not apply to Consumers.
10. Changes and final provisions
- We may change these Terms for important reasons (changes in law, in the scope of services or payment methods, security). We will inform you by e-mail at least 14 days before the change takes effect; if you do not agree, you may terminate the contract in that time.
- Polish law applies. This choice of law does not deprive Consumers of the protection granted by the law of their country of habitual residence.
- The processing of personal data and cookies is described in the Privacy Policy.
- This English version is provided for convenience; the Polish version prevails for Users paying in PLN.
Effective from 26.10.2026
